Important Information about Your Order

Due to flexible organization, actual instructors may change on multiple occasions.

We reject any liability whatsoever for all accidents which may occur during or before ski lessons. Accident and liability insurance are a personal matter for course participants.

Fee reimbursement due to injury or illness is only possible with a physician & rsquo;s attestation. Only unused days (remaining difference) are reimbursed.

Lessons canceled due to prevailing weather conditions (force majeure) are not made up.

Private courses are held in all weather conditions.

The course ticket is non-transferrable! Unused course days are forfeited!

All deliveries and services of the ski school resulting from online bookings via the Internet or other online services are subject to these terms and conditions.

Online Content

The ski school / ski rental center (hereafter referred to as "author") assumes no liability whatsoever for the topicality, correctness, completeness or quality of the information provided. Liability claims against the author, related to material or ideal damage and which have been caused by the use or improper use of the information provided, or by the use of inaccurate and incomplete information, are expressly ruled out in so far as the author has not acted in a way which is demonstrably either intentionally or grossly negligent.

All offers are subject to change and are non-binding. The author reserves the expressed right to amend, add to or delete parts of pages, or the entire offer, without special notice.

References and Links

With regards to direct or indirect references to external Internet sites ("links") which are themselves outside the field of responsibility of the author, liability for illegal content will only then be assumed if the author has knowledge of the content of those sites and it is technically feasible and reasonable for the author to prevent usage of said sites.

The author hereby expressly declares that, at the time links were installed on this site, no illegal content was apparent on the targeted sites. This declaration applies to all links placed within its own Internet site, as well as to entries in mailing lists created by the author and to comments in the photo gallery.

Sole liability for illegal, erroneous or incomplete content, and particularly for damages which might by caused by use or non-use of any such information supplied, is borne by the provider of the target site, and not by the provider who included a link to that particular site.

Copyright and Trademarking

The author makes every effort in all publications to respect copyright on all graphics, audio files, video clips and texts, and to make use of self-created graphics, audio files, video clips and texts, or to avail himself of non-licensed graphics, audio files, video clips and texts.

All those brand names and trademarks cited in the author's Internet platform, some of which are, on occasion, protected by third parties, are subject without restriction to applicable copyright laws and the proprietary rights of the registered owners. The conclusion should not be drawn from their mere naming, that trademarks are not protected by third-party rights.

Copyrights for those objects published and created by the author himself, remain solely with the author. Duplication or use of such graphics, audio documents, video clips and texts in other electronic or print publications, is not permitted, except with the expressed permission of the author.

Booking and Reservation of Ski and Snowboard Courses

Fees for ski courses do not include use of ski lifts. The ski school does not provide compensation for instructional time lost due to interruptions in lift service.

Payment

Credit card payments in favor of the ski school are collected by TREKKSOFT AG, Hauptstrasse 15, 3800 Matten, Switzerland ("TREKKSOFT"). TREKKSOFT will appear as TREKKSOFT TOUR BOOKING on your credit card statement. The domain where you enter and process your payment is owned and operated by TREKKSOFT.Please send an e-mail to support@payyo.ch for all inquiries regarding your credit card payments and chargebacks.

Jurisdiction, Place of Delivery and Legal Options

Place of delivery is the headquarters of the ski school center. In the event of dispute, the court with jurisdiction at the location of the headquarters of the ski school / ski rental center will adjudicate the matter. All matters are governed by Austrian law. The contractual language is German.

Right of cancellation

For private courses, it is possible to withdraw from the contract by 5 p.m. on the previous day at the latest without incurring a cancellation fee. However, if the cancellation is made at a later time, the ski school is entitled to charge the agreed rate for the booked service. Cancellations during an ongoing service or no-shows on the agreed date will not be refunded.

If the weather conditions do not guarantee the performance of the service for safety reasons, the ski school reserves the right to postpone or cancel the services.

The ski school is entitled to withdraw from the contract at any time if the customer participates in courses under the influence of alcohol, drugs or medication, which makes safe participation no longer possible.

The same applies if the customer persistently disobeys the instructions of the ski school, the instructors or the supervisors; the customer is not entitled to any claims in the event of such a cancellation of the contract; in particular, the customer is also obliged to pay the full fee

Impossibility of the service

If it is not possible to provide the service for safety reasons (e.g. weather conditions, avalanche danger, etc.), the ski school is not obliged to provide the service. It is at the sole discretion of the ski school to assess the impossibility of providing the service, whereby a partial impossibility - e.g. no ski lessons are possible on three out of five days - does not affect the realization of the possible part of the service.

In the event of (partial or complete) impossibility of performance, the ski school will decide whether to add any cancelled courses to the end of the course or, if this is not possible, to issue a credit note for the proportionate fee. The customer is not entitled to any further claims.

Force majeure, in particular epidemics, pandemics, official measures such as closures, other unforeseeable and unavoidable events release the ski school from its performance obligations.

Service provision

The customer must arrive at the meeting point of the ski school or at another location in the ski school area specified by the ski school in good time before the start of the course.

The ski school reserves the right to change the meeting point of the courses at short notice. In such cases, customers will be informed by the ski school.

The ski school undertakes to employ only qualified instructors or child carers for the respective service.

Limitation of liability

In connection with the courses offered, the ski school does not guarantee the success of the course participants' training.

The ski school assumes no liability for damages that the customer causes to himself or other persons during the execution of the agreed service through no fault of the ski school or that are caused to him by them.

Irrespective of fault, the ski school is not liable for loss of profit, pure financial loss and consequential damage.

The customer is advised that failure to wear a helmet in the event of injury may constitute contributory negligence on the part of the customer, which is why the customer is advised to wear a helmet and other safety equipment recommended for the booked se to be carried. Crash helmets and safety equipment generally reduce the risk of injury.

It is expressly stated that the practice of snow sports is associated with numerous risks and that there is an increased risk of injury or even death, especially on tours or descents in open terrain.

Injuries or even death, in particular due to avalanches, which cannot be completely ruled out.

The customer acknowledges that a rescue from pistes or in open terrain is often associated with high costs. The customer is therefore advised to take out appropriate insurance, especially as the ski school is not liable for rescue and air rescue costs srvive (e.g. avalanche transceiver for skiing in open terrain) or, in the case of avalanche equipment, to wear an avalanche transceiver.

Obligations of the customer

The customer must inform the ski school truthfully and comprehensively about his abilities and experience in the type of snow sport booked in each case and must independently ensure that he has equipment appropriate to the level of skiing technique and the external conditions. The customer must inform the ski school of any health conditions or impairments.

Before the start of the lesson, the customer must independently arrange for his ski equipment (in particular ski bindings) to be checked by a specialized company.
